Property API Self-Serve Terms
This is the immutable Terms artifact for the version above. It applies only when this exact Terms version, the applicable product version, Licence version and Source Schedule version, together with explicit clickwrap acceptance, are recorded on the Stripe Checkout Session and Subscription.
1. Operator and acceptance
These Terms govern use of DA Leads (ABN 12 305 679 180), referred to as “DA Leads”, “we”, “us” or “our”. By expressly accepting this version at checkout, the subscribing organisation agrees to this document, the accepted Property Self-Serve Licence, the accepted product version and the accepted Property Intelligence Source Schedule. If the organisation does not agree, it must not subscribe or use paid Self-Serve access.
2. Accounts and security
The subscriber is responsible for its account, API keys and use by its personnel and contractors under its control. Keys must not be shared outside the subscribing organisation or exposed in client-side code, public repositories or another reusable service.
3. Subscriptions, GST and cancellation
Property Self-Serve subscriptions are billed monthly through Stripe and renew automatically until cancelled. Public prices are final GST-inclusive totals. Noise Intelligence, Flood Intelligence and Bushfire Screening are each A$199 per month and include 1,000 Unique Addresses per calendar month. Full Property Intelligence is A$2,499 per month and includes 500 Unique Addresses in each activation-anchored monthly billing period.
The subscriber may cancel through its Account page. Access continues only for the paid period and while payment and acceptable-use requirements remain satisfied. No refund is provided for a partial month except where required by law.
4. Product and licence boundary
Paid access is limited to the exact components and rights in the accepted product and Licence versions. Technical availability of another field, source, model, component or endpoint does not add it to the subscription. Coverage, attribution, withholding and source-specific restrictions in the accepted Source Schedule and each API response form part of the delivery boundary.
5. Evaluations
A no-card evaluation is temporary, limited to its displayed quota and for internal evaluation only. It does not grant production integration, customer-report, embedding, redistribution or onward-access rights. An organisation that has created a paid Stripe generation for a product cannot obtain a later free evaluation for that product by becoming past due, paused or cancelled.
6. Acceptable use
The subscriber must not scrape or reconstruct the Service or an upstream dataset; bypass a rate, field, component, geography, history, quota or expiry restriction; resell, sublicense or redistribute the data; give a third party onward database access; remove required attribution or coverage statements; use an API key outside its organisation; or use the Service unlawfully.
Noise, Flood and Bushfire plans permit internal screening only. Full additionally permits attributed output in static customer reports as specified by the accepted Licence. Interactive embedding, white-label delivery, bulk extraction, redistribution, special geometry, onward database access and service-level commitments require a separately agreed Publisher, Enterprise or other written licence.
7. Accuracy and professional decisions
The Service aggregates public and third-party sources whose coverage, currency and accuracy vary. A missing, unavailable or unchecked source is not a clear result. Property Intelligence is automated screening, not statutory, engineering, acoustic, hydraulic, environmental, bushfire, BAL, insurance, valuation, legal or building-approval advice. A preliminary indicative BAL band, where delivered, is not a certified BAL assessment and cannot be used for building approval. The subscriber must obtain appropriate professional and official confirmation for decisions requiring it.
8. Intellectual property and attribution
DA Leads owns the Service design, code, branding and its derived model outputs. Underlying data remains subject to its source terms. The subscriber must preserve response-specific attribution. OpenStreetMap-derived material requires “© OpenStreetMap contributors” and may carry Open Database License obligations described in the Source Schedule and response.
9. Version changes
A later product, Terms, Licence or Source Schedule version is not accepted automatically through continued use. Existing Self-Serve rights remain governed by the exact bundle recorded for the subscription unless the parties validly accept or agree to another version. A new or changed bundle must be expressly accepted before it can authorize new access.
10. Liability and governing law
To the maximum extent permitted by Australian law, DA Leads is not liable for indirect, incidental or consequential damages arising from use of the Service. These Terms are governed by the laws of Victoria, Australia.
