Tree removal proposal in relation to clause 52.37 Canopy Trees. We are seeking a permit to remove & replace a canopy tree on the property.

Removal and replacement of 2 existing trees in front setback. Written Statement – Tree Removal (Trees 7 and 9) Tree details (species, height and trunk girth) Tree 7 – Brachychiton populneus (Kurrajong) • Height: approximately 12 metres • Trunk girth: approximately 204 cm (derived from DBH 65 cm) Tree 9 – Quercus palustris (Pin Oak) • Height: approximately 15 metres • Trunk girth: approximately 173 cm (derived from DBH 55 cm) Both trees are established canopy trees located along the front boundary of the site. Reason for removal Trees 7 and 9 are located directly adjacent to the front boundary fence in a constrained position that limits their ability to develop appropriately and restricts the functional use and design of the front setback. Their proximity to the boundary reduces available soil volume, limits canopy spread, and creates ongoing conflict with site layout, access, and landscape outcomes. Removal of these trees is proposed to enable a more appropriate and sustainable landscape arrangement within the front setback, including the establishment of replacement canopy trees in improved growing conditions that better support long-term health and canopy development. Replacement planting Replacement planting will be undertaken on the site. Two (2) replacement trees (Quercus palustris – Pin Oak) will be planted within the front setback, positioned several metres inside the boundary. The revised location will provide improved soil volume, reduced constraint, and appropriate spacing to allow full canopy development. This will result in a stronger long-term landscape outcome and ensure no net loss of canopy within the site.

Our neighbours at 25 Winton Road, have launched legal action against us to have the tree removed. Through their lawyer, they have threatened to cut the tree roots if we do not apply to have the tree removed. However, we would only like to prune the canopy of our tree, as per the recommendation from the arborist (see attached document)

Removal of boundary canopy tree

Remove, destroy or lop a tree (if the schedule to this Overlay specifies the Heritage place as one where tree controls apply) in a Heritage Overlay. Two arborists have recommended the removal of a mature Liquidamber Styraciflua tree (fungus growth) located at front of property. Potential Powercor works. Advise of outcome if works cost less than $10,000.

Remove, destroy or lop trees in a Neighbourhood Character Overlay

Tree Removal: We require a planning permit to facilitate the removal of an existing canopy tree located on the owner’s property. As part of the tree removal application and crossover application, associated works including a new crossover, driveway and amendments to the existing front fence are also proposed. Please refer to the plans and arborist report for further information.

Maintenance pruning of 4 trees to ensure future well-being of trees and as risk mitigation of neighbouring property as recommended by an arborist - see attached documents for details and photographs.

We are applying for a Tree Works Permit to remove a large tree from our residential premises. The initial consult was with Mark Phillips - Arborist [email protected] - who advised this is the route we need need to take to obtain this permit.
