Terms of Service

1. Acceptance of Terms

These Terms govern your use of DA Leads (ABN 12 305 679 180), referred to in these Terms as "DA Leads", "we", "us" or "our". By accessing or using the Service, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

DA Leads provides aggregated development application (DA) data sourced from publicly available council planning registers across Australia. The Service categorises this data by trade type and presents it through a web-based dashboard.

3. Accounts and Access

You may browse DA leads without an account. To access premium features, you must sign in via Google OAuth and subscribe to a paid plan. You are responsible for maintaining the security of your account.

4. Subscriptions and Payment

Website Pro and DA Data subscriptions are billed via Stripe on the period shown at checkout. Every public Self-Serve price displayed by DA Leads is the final GST-inclusive customer total. Property Self-Serve subscriptions are billed monthly. You may cancel from your Account page and retain access until the end of the current paid month. No refund is provided for a partial month.

Noise Intelligence, Flood Intelligence and Bushfire Screening are each A$199 per month including GST and include 1,000 Unique Addresses per calendar month. Full Property Intelligence is A$2,499 per month including GST and includes 500 Unique Addresses in each activation-anchored monthly billing period. Each renews automatically each month until cancelled.

4A. Property API Self-Serve Contract

The current Property API Self-Serve terms version is api-self-serve-terms-2026-09-01. Before a paid Checkout Session can be created, you must expressly agree to the product version, these Terms, the versioned Property Self-Serve Licence and the versioned Property Intelligence Source Schedule shown beside the checkout control. We record those exact versions in the Checkout Session and Subscription metadata. If any submitted version is missing or stale, checkout does not open.

A no-card evaluation is not a paid subscription and grants only temporary internal evaluation rights. Paid use remains limited to the components and rights in the accepted product version. A later product, source or licence version is not added automatically merely because the API can technically return it.

5. Data Accuracy

DA data is sourced from public council registers and third-party providers. We make reasonable efforts to ensure accuracy but do not guarantee completeness or timeliness. We are not liable for decisions made based on the data provided.

Property Intelligence components are automated screening tools. Coverage varies by source and jurisdiction and is stated in the response. A checked-clear register, numeric score, environmental-audit location or unavailable source does not certify that land is uncontaminated or suitable for a proposed use. Contamination Screening is not a clean-site certificate, Phase 1 or Phase 2 environmental site assessment, laboratory result or professional environmental advice.

6. Acceptable Use

You agree not to: (a) scrape, copy or redistribute the data in bulk outside an authorised API plan; (b) use automated tools to access the web interface beyond normal browsing; (c) share API keys or bypass rate, field, category, geography, history or expiry restrictions; or (d) use the Service for any unlawful purpose.

Starter and Scale API plans permit use by the subscribing organisation for its own internal research, analysis and workflows. They do not permit embedding the data in a customer-facing product, giving third parties onward database access, or reselling, sublicensing or redistributing the feed. Those uses require a separately agreed Enterprise licence.

Noise, Flood and Bushfire component plans permit internal screening only. Bushfire Screening includes a preliminary indicative BAL band (with range and confidence), delivered with a mandatory disclaimer. It does not include a certified BAL assessment and cannot be used for building approval. Full Property Intelligence additionally permits attributed outputs in static customer reports and contains only Property Core factual components, Noise, aircraft-noise, Flood and Bushfire screening, and Suburb Intelligence under its accepted version. It does not include Solar, Contamination Screening, Heat, Landscape Openness or Walkability Preview/Pilot. Interactive embedding, white-label delivery, onward database access, bulk extraction, reselling, sublicensing, redistribution, special geometry delivery and a service-level agreement require a separately agreed Publisher or Enterprise licence.

Trial and evaluation keys may be restricted by category, state, lodgement period, request volume and expiry date. A trial does not grant production, redistribution or commercial integration rights.

7. Intellectual Property

We own the Service's design, code and branding. The aggregated datasets, derived analytics and structured data published on the Service are made available subject to these Terms of Service. Underlying DA data is sourced under Creative Commons licences or public register terms as attributed on the site.

Some fields in the property intelligence API are derived from OpenStreetMap, which is licensed under the Open Database License (ODbL 1.0) rather than Creative Commons. Where a response contains them, it says so: meta.noise_sources and meta.amenity_sources carry the applicable attribution text, and the API reference names the specific fields. If you use those fields you must display the credit "© OpenStreetMap contributors" wherever the names or coordinates appear, and if you incorporate them into a database you make publicly available, you must offer that database on the same terms. Reports, maps and analyses you produce from them are produced works and need the credit only. Scores, distances and decibel figures we compute are our own output and carry no ODbL condition. Responses mark these fields per request, so a use case that cannot accommodate ODbL terms can discard them and rely on the remainder, which is Creative Commons or public register data.

8. Limitation of Liability

To the maximum extent permitted by Australian law, we are not liable for any indirect, incidental or consequential damages arising from your use of the Service.

9. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms, except for a versioned Property API Self-Serve contract bundle. A later Self-Serve product, Terms, Licence or Source Schedule version is not accepted through continued use; it must be expressly accepted and recorded as described in section 4A.

These Terms are governed by the laws of the State of Victoria, Australia.
