Front-yard landscaping and maintenance
We would like to redesign and landscape the front yard in a different way that is easier to maintain, particularly as we are not at home all the time. Removing the tree would allow us to create a more practical and manageable landscape.
Proximity to the house and potential structural damage
The tree is tall and located very close to the basement and the foundations of the house. We have already noticed cracks appearing on the wall in the vicinity of the tree roots. We are concerned that continued root growth could potentially cause further damage to the structure in the future. Removing the tree now would help minimise the risk of the existing damage becoming worse.
Protection of future landscaping and pathways
We intend to install new landscaping and footpaths in this area. The tree roots could potentially cause the ground and pathways to become uneven over time, creating a trip hazard and potentially damaging the new landscaping. Removing the tree would allow us to establish the area properly and reduce the likelihood of future disruption or injury to occupants.
Risk from falling palm branches
As the tree is a palm, large branches/fronds have already fallen and caused damage to parked vehicles. Given the tree's height and its location, we are concerned about the potential for falling branches to cause further property damage or, more importantly, injury to people.
Location within the property
The tree is situated in the middle of the property rather than on the boundary or towards the side of the property. Its current location increases the potential impact on the house, vehicles, pathways and people using the property. If the tree were located on the boundary or away from these areas, the risks would be considerably less.
For these reasons, we believe removing the tree would be a reasonable preventative measure to protect the house, future landscaping, vehicles and, most importantly, the safety of the occupants.

Subject: Planning Permit Application for Canopy Tree Removal and Complete Stump Grinding
Dear Planning Officer,
I am writing to formally request a planning permit to safely remove and completely grind down the stump of one large mature Eucalyptus (Gum) tree located behind our property at 1/5 Hocking court, Mt Waverley VIC 3149.
The tree currently meets the canopy criteria under the Monash Planning Scheme (being over 5 metres in height with a significant trunk circumference). However, it now poses an unacceptable risk to personal safety and residential property, requiring urgent intervention.
I request the council approve full removal and stump grinding based on the following critical points:
• Immediate Safety Hazard: Tree roots have caused persistent drainage issue at the toilet, bathrooms causing massive inconvenience to tenants for last few years. As advised by licensed plumber, Tree roots have penetrated into the sewage/drainage and stormwater pipes causing water leakages. Plumber advised that water leakages will cause structural damages to the building at unit 1. Tree roots have also caused damage to drainage pipes of adjoining unit 2 as well around 3 years ago which resulted in high costs which were incurred by the Unit 2 owner. Pictures of the broken pipes and the tree roots penetrating the pipes have been attached. Invoice from the plumber has been attached. Digup and pipe repair, replacement and all the works were completed on 20th June’2026, Saturday.Total costs for the plumbing works at Unit 1 were quite high- $9,900
• Proximity to Dwelling: The tree is situated directly adjacent to the main residential home. Large overhanging limbs pose an immediate threat to the tiled roof, windows, and anyone utilizing the entryways or paths below. Tenants at Unit 1 and Unit 2 have been complaining of the risk of the branch falling either into their parked car or on themselves causing serious injury. Also tree roots can potentially cause damage to the building foundation and the wall due to stormwater seeping into the building slab due to the damage to stormwater, drainage pipes by the tree roots.
• Complete Hazard Mitigation (Stump Grinding): To fully eliminate the risk and prevent future hazards, the project scope includes grinding the stump to below ground level.
• Enclosed Supporting Documentation:
1. A copy of the Certificate of Title and site plan, tree location highlighted in green on the site plan.
2. Clear photographs highlighting the tree's proximity to the house.
3. A basic site plan showing the exact location of the tree and the footprint of the house.
4. Pictures of the dig up of the paved concrete in the backyard, damaged pipes due to the roots and replaced pvc pipes.
I kindly ask that this application be reviewed under Council’s fast-track planning process. Thank you for your time and prompt consideration of this matter.

The tree's root system has significantly lifted the paved driveway and adjoining footpath, creating an uneven surface that presents a serious safety hazard. The raised paving poses a risk of trips and falls for our renters, visitors, and pedestrians using the path.
Given the extent of the root intrusion and the associated public safety concerns, we respectfully request approval for the removal of the tree to prevent further damage to the surrounding infrastructure and to ensure the safety of all occupants and members of the public.
